By using this site (the "Site"), a consumer (the "End User" or “End Users”) or merchant companies offering coupons or advertising (a “Merchant” or “Merchants”) – collectively, Consumers and Merchants may be referred to as “You” – agree to the terms and conditions that we ("MyHomeCoupons.com") have provided. If you do not agree to the outlined terms and conditions (the "Terms of Use" or "Agreement"), you may not use the Site.  
 
MyHomeCoupons.com reserves the right to make any changes to our Terms of Use and/or our Privacy Policy (which is incorporated herein by reference) as we deem necessary or desirable without prior notification to you. We suggest to you, therefore, that you re-read this important notice containing our Terms of Use and Privacy Policy from time to time in order that you stay informed as to any such changes. By using this Site (other than to read this Agreement for the first time), End Users or Merchants agree to comply with all of the terms and conditions herein. The right to use this Site is personal to an End-User or Merchant and is not transferable to any other person or entity. An End-User or Merchant shall be responsible for protecting the confidentiality of their password(s), if any. The End-User or Merchant acknowledges that, although the Internet is often a secure environment, sometimes there are interruptions in service or events that are beyond the control of MyHomeCoupons.com. MyHomeCoupons.com shall not be held responsible for any data lost while transmitting information on the Internet. While it is our objective is to make the Site accessible 24 hours per day, 7 days per week, the Site may be unavailable from time to time for any reason including, without limitation, routine maintenance. 4. Equipment.

An End-User or Merchant shall be responsible for obtaining and maintaining all computer hardware and other equipment needed for access to and use of this Site and all charges related thereto. MyHomeCoupons.com shall not be liable for any damages to an End-User’s or Merchant’s equipment resulting from the use of this Site. 
 

5. End User or Merchant Conduct.

This Site and any individual Merchant microsites now or hereinafter contained within or otherwise available through external hyperlinks from our Site (the "Microsites") are private property. All interactions on this Site and/or Microsites must comply with these Terms of Use. Although we welcome and encourage user interaction on our Site, we do insist and require that all End-Users or Merchants restrict any and all activity in connection with the use of this Site and the Microsites to that which involves lawful purposes only. End-Users or Merchants shall not post or transmit through this Site any material which violates or infringes in any way upon the rights of others, or any material which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without MyHomeCoupons.com's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by an End User or Merchant that, in MyHomeCoupons.com's exclusive discretion, restricts or inhibits any other End User or Merchant from using or enjoying this Site and/or any of the Microsites is strictly prohibited. An End User or Merchant shall not use this Site or any Microsites to advertise or perform any commercial, religious, political or non-commercial solicitation, including, but not limited to, the solicitation of End Users or Merchants of this Site and/or the Microsites to become users of other online or offline services directly or indirectly competitive or potentially competitive with MyHomeCoupons.com. 
 
The foregoing provisions of this Section 5 apply equally to and are for the benefit of MyHomeCoupons.com, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf. 
 
6. Copyright and Trademarks.

Everything located on or in this Site, including the Microsites, is the exclusive property of MyHomeCoupons.com, Inc. or used with express permission of the copyright and/or trademark owner. ANY COPYING, DISTRIBUTING, TRANSMITTING, POSTING, LINKING, DEEP LINKING, OR OTHERWISE MODIFYING OF THIS SITE OR ANY OF THE MICROSITES WITHOUT THE EXPRESS WRITTEN PERMISSION OF MYHOMECOUPONS.COM, INC. IS STRICTLY PROHIBITED. Any violation of this policy may result in a copyright, trademark or other intellectual property right infringement that may subject an End User or Merchant to civil and / or criminal penalties. 
 
This Site contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music, sound, and the entire contents of MyHomeCoupons.com, which is protected by copyright as a collective work under the United States copyright laws. MyHomeCoupons.com owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. An End User or Merchant may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. An End User or Merchant may download / print / save copyrighted material for an End User’s or Merchant’s personal use only. Except as otherwise expressly stated under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material without the express, written permission of MyHomeCoupons.com as the copyright owner is permitted. If copying, redistribution or publication of copyrighted material is permitted, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The End User or Merchant acknowledges that he/she/it does not acquire any ownership rights by downloading copyrighted material. Trademarks that are located within or on the Site or a website otherwise owned or operated in conjunction with MyHomeCoupons.com shall not be deemed to be in the public domain but rather the exclusive property of MyHomeCoupons.com, unless such site is under license from the Trademark owner thereof in which case such license is for the exclusive benefit and use of MyHomeCoupons.com, unless otherwise stated. 

An End User or Merchant shall not upload, post or otherwise make available on this Site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right. MyHomeCoupons.com does not have any express burden or responsibility to provide an End User or Merchant with indications, markings or anything else that may aid an End User or Merchant in determining whether the material in question is copyrighted or trademarked. An End User or Merchant shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights or any other harm resulting from such a submission. By submitting material to any public area of this Site, an End User or Merchant warrants that the owner of such material has expressly granted MyHomeCoupons.com the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. The foregoing provisions of Section 6 apply equally to and are for the benefit of MyHomeCoupons.com, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf. 
 
7. Disclaimer of Warranty; Limitation of Liability.

THE END USER OR MERCHANT EXPRESSLY AGREE THAT USE OF THIS SITE AND THE MICROSITES IS AT END USER'S OR MERCHANT’S SOLE RISK. NEITHER MYHOMECOUPONS.COM, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO (I) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THIS SITE, OR (II) THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE OR MERCHANDISE PROVIDED THROUGH THIS SITE OR THE MICROSITES.

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. END USER SPECIFICALLY ACKNOWLEDGES THAT MYHOMECOUPONS.COM IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS, MERCHANTS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH END USER OR MERCHANT. 
 
IN NO EVENT SHALL MYHOMECOUPONS.COM, OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THIS SITE OR THE CONTENTS HEREOF, INCLUDING THE MICROSITES AND ANY SOFTWARE, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SITE. AN END USER OR MERCHANT HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THIS SITE AND THE MICROSITES. 
 
IN ADDITION TO THE TERMS SET FORTH ABOVE, NEITHER MYHOMECOUPONS.COM, NOR ITS AFFILIATES, MERCHANTS, INFORMATION PROVIDERS OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED WITHIN THIS SITE OR ANY OF THE MICROSITES, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE END USER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING WITHOUT LIMITATION LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES. 
 
MYHOMECOUPONS.COM IS NOT RESPONSIBLE FOR ANY CONTENT THAT AN END USER, MERCHANT, OR AN UNAUTHORIZED END USER OR MERCHANT MAY POST ON THIS SITE OR ANY OF THE MICROSITES. ANY CONTENT THAT IS POSTED OR UPLOADED THAT IS OR MAY BE DEEMED UNSUITABLE CAN AND MAY BE TAKEN DOWN BY MYHOMECOUPONS.COM. MOREOVER, MYHOMECOUPONS.COM RESERVES THE RIGHT TO EDIT, CHANGE, ALTER, DELETE AND PROHIBIT ANY AND ALL CONTENT THAT IT, MYHOMECOUPONS.COM, DEEMS UNSUITABLE.  
 
8. Monitoring.

MyHomeCoupons.com shall have the right, but not the obligation, to monitor the content of the Site at all times, including any chat rooms and forums that may hereinafter be included as part of the Site, to determine compliance with this Agreement and any operating rules established by MyHomeCoupons.com, as well as to satisfy any applicable law, regulation or authorized government request. Without limiting the foregoing, MyHomeCoupons.com shall have the right to remove any material that MyHomeCoupons.com, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.  
 
9. Privacy.

End User acknowledges that all discussion for ratings, comments, bulletin board service, chat rooms and/or other message or communication facilities (collectively "Communities") are public and not private communications, and that, therefore, others may read an End User's or Merchant’s communications without the End User's or Merchant’s knowledge. MyHomeCoupons.com does not control or endorse the content, messages or information found in any Community, and, therefore, MyHomeCoupons.com specifically disclaims any liability concerning the Communities and any actions resulting from an End User’s or Merchant’s participation in any Community, including any objectionable content. Generally, any communication which an End User or Merchant posts to MyHomeCoupons.com (whether in chat rooms, discussion groups, message boards or otherwise) is considered to be non-confidential. If particular web pages permit the submission of communications that, in fact, will be treated by MyHomeCoupons.com as confidential, that fact will be stated on those pages. By posting comments, messages or other information on the Site, an End User or Merchant grants MyHomeCoupons.com the right to use such comments, messages or information for promotions, advertising, market research or any other lawful purpose. 10. License Grant.

By posting communications on or through this Site, an End User or Merchant shall be deemed to have granted to MyHomeCoupons.com a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sub-licensees. 
 
11. Indemnification.

End Users and Merchants agree to defend, indemnify and hold harmless MyHomeCoupons.com, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of this Site and/or the Microsites by an End User or Merchant. 
 
12. Termination.

MyHomeCoupons.com may terminate this Agreement at any time. Without limiting the foregoing, MyHomeCoupons.com shall have the right to immediately terminate any passwords or accounts of an End User or Merchant in the event of any conduct by the End User or Merchant which MyHomeCoupons.com, in its sole discretion, considers to be unacceptable, or in the event of any breach by an End User or Merchant of this Agreement. The provisions of Sections 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14 and 15 shall survive termination of this Agreement. 
 
13. Trademarks.

MyHomeCoupons.com is a trademark of MyHomeCoupons.com, Inc. All rights in respect of this trademark are hereby expressly reserved. Unless otherwise indicated, all other trademarks appearing on MyHomeCoupons.com are the property of their respective owners. 
 
14. Third Party Content.

MyHomeCoupons.com, similar to an Internet Service Provider, is a distributor (and not a publisher) of content supplied by third parties, Merchants or End Users. Accordingly, MyHomeCoupons.com has no more editorial control over such content than does a public library, bookstore or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Merchants or any other End Users are those of the respective author(s) or distributors) and not of MyHomeCoupons.com. Neither MyHomeCoupons.com nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. (Refer to Section 7 above for the complete provisions governing limitation of liabilities and disclaimers of warranty.) 
 
In many instances, the content available through this Site represents the opinions and judgments of the respective information provider, Merchant, End User, or other user not under contract with MyHomeCoupons.com. MyHomeCoupons.com neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on MyHomeCoupons.com by anyone other than authorized MyHomeCoupons.com employee spokespersons while acting in official capacities. Under no circumstances will MyHomeCoupons.com be liable for any loss or damage caused by an End User's or Merchant’s reliance on information obtained through MyHomeCoupons.com. It is the responsibility of an End User or Merchant to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, etc., or other content available through MyHomeCoupons.com. 
 

MyHomeCoupons.com contains links to third party Web sites maintained by other content providers. These links are provided solely as a convenience to you and not as an endorsement by MyHomeCoupons.com of such third-party site content and MyHomeCoupons.com hereby expressly disclaims any representations regarding the content or accuracy of materials on such third-party websites. If an End User or merchant decides to access linked third-party Web sites, the End User or Merchant does so at its own risk. Unless you have executed a written agreement with MyHomeCoupons.com expressly permitting you to do so, you may not provide a hyperlink to the Site from any other website. MyHomeCoupons.com reserves the right to revoke its consent to any link at any time, at its sole discretion. 
 
15. Force Majeure.

MyHomeCoupons.com shall incur no liability to End User or Merchant with respect to and shall not be responsible for any failure to perform, any of the obligations of MyHomeCoupons.com hereunder if such failure is caused by any reason beyond the control of MyHomeCoupons.com including, but not limited to strike, labor trouble, governmental rule, regulations, ordinance, statute or interpretation, fire, earthquake, civil commotion, or failure or disruption of utility or wireless services.  The amount of time for MyHomeCoupons.com to perform any of the obligations of MyHomeCoupons.com shall be extended by the amount of time MyHomeCoupons.com is delayed in performing such obligation by reason of any force majeure occurrence whether similar to or different from the foregoing types of occurrences. 
 
16. Miscellaneous.

This Agreement and any operating rules for MyHomeCoupons.com, established unilaterally or otherwise by MyHomeCoupons.com, constitute the entire agreement of the parties with respect to the subject matter herein. No waiver by either party of any breach or default hereunder is a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall be of no legal force or effect. If any provision of this Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in this Agreement and the remaining portions of this Agreement shall continue in full force and effect. The failure of either party to exercise any of its rights under this Agreement shall not be deemed a waiver or forfeiture of such rights or any other rights provided hereunder. 
 
MyHomeCoupons.com's headquarters are in Farmington Hills, Michigan. Legal issues arising out of, but not exclusive to the use of, this Site or the Microsites (unless otherwise specifically stated) are governed by and in accordance with the laws of the State of Michigan (exclusive of its rules regarding conflicts of laws). By using this Site, an End User or Merchant agrees that any dispute or claim arising out of or in connection with this Agreement or the performance, breach or termination thereof, or the Site or any Microsite, shall be finally settled by arbitration in Detroit, Michigan under the Commercial Mediation rules of arbitration of the American Arbitration Association. This settlement shall be enforceable in a Court of Law. 
 

II. TERMS OF SALE – MERCHANT POSTING OF COUPON(S) OR ADVERTISEMENT(S)  
 
By placing an Order, a Merchant agrees to pay such fees and costs, as indicated at the time of purchase, in exchange for MyHomeCoupons.com making available the same coupon(s) and/or online advertisement(s), provided by the Merchant at the time of sale, to End Users based on the State(s)/County(s) selected by the Merchant at the time of sale. Fees and costs associated with the Merchant orders described herein may change at any time, at the sole discretion of MyHomeCoupons.com. By placing such an order, you agree to the specific terms and conditions described below as well as the Terms & Conditions stated elsewhere in this document.  
 
1. Terms and Conditions for Merchant-Offered Coupons

• A Merchant may purchase one or more coupon postings within a single transaction.  
• The fees and/or costs paid during each transaction shall be on a “per coupon” basis. The associated fees and/or costs are indicated at the time of sale through our website. 
• The “Per Coupon” fee is a one-time, flat fee, as indicated at the time of purchase, regardless of the total number of coupons distributed to End Users. The Merchant has the ability, at the time of purchase, to determine the maximum number of coupons it wishes to have MyHomeCoupons.com distribute to End Users. The Merchant has the ability, at the time of purchase, to determine the length of time it wishes to have MyHomeCoupons.com distribute said coupons to End Users, up to a maximum of 180 days. MyHomeCoupons.com does not guarantee distribution of a minimum number of Merchant’s coupons. 
• As provided elsewhere in this document, MyHomeCoupons.com reserves the right to approve and/or edit prior to approval any and all coupon content in coordination and with the consent of the Merchant. In the event that MyHomeCoupons.com and the Merchant cannot reach agreement as to appropriate content, the Merchant agrees it only has a right to receive a refund of any fees paid for the specific coupon in question. All rights to further compensation, remuneration or damages is hereby relinquished. 
• The Merchant hereby acknowledges that MyHomeCoupons.com is authorized to sell Merchant-provided coupons to End Users for the benefit of MyHomeCoupons.com and/or the local home builder and remodeler associations (the “HBA” or “HBAs) with whom MyHomeCoupons.com has entered into separate agreement.  
• The Merchant hereby understands and acknowledges that MyHomeCoupons.com works with local HBAs to help generate revenues back to the local HBA, in order to enhance HBA programs and services to its members, through the sale of Merchant coupons and/or advertisements by MyHomeCoupons.com. The Merchant hereby acknowledges that they are, at the time of the purchase, a member in good standing with the local HBA by which they have accessed this Site, using a unique login number and PIN. The Merchant hereby agrees not to seek any compensation or claim to other financial benefit accruing from the sale of coupons through this Site, either from MyHomeCoupons.com or its local HBA. 
• MyHomeCoupons.com agrees to provide the Merchant with timely e-mail notification when an End User has purchased a coupon. This notification may include the End User’s: Name, Address, Phone Number, e-mail, the “last 4-digits” of their credit card and a unique barcode number generated by MyHomeCoupons.com for the purposes of ensuring that a coupon presented by a person or persons at a Merchant’s place of business was generated by a valid purchase transaction using MyHomeCoupons.com. The Merchant hereby agrees to honor any and all coupons presented by an End User that match the unique barcode number generated by MyHomeCoupons.com at the time of the End Users purchase through MyHomeCoupons.com.  
• Based on the nature of the Internet, downtimes may occur that are outside of the control of MyHomeCoupons.com. MyHomeCoupons.com’s goal is to ensure that our site is returned to operations within 72 hours of any downtime occurrence. 
• Merchant-Specific Coupons cannot be combined with any other coupons or promotions, without the express consent of the merchant offering a coupon through MyHomeCoupons.com.  
• Merchant-Specific Coupons cannot be used for taxes or prior balances.  
• No cash value for Merchant-Specific Coupons.  
• No cash back upon redemption or at any other time.  
• The issuing of merchant credit is at the sole discretion of the merchant unless otherwise required by law.  

• Neither the MyHomeCoupons.com nor the merchant is responsible for lost or stolen coupons or merchant coupon reference and/or barcode numbers.  
• Reproduction, sale or trade of Merchant-Specific Coupons is prohibited unless done so in compliance with the law.  
• Any attempted redemption not consistent with these terms & conditions will render the Merchant-Specific Coupon(s) void to the extent allowed by law.  
• Merchant-Specific Coupons expire one (1) year from date of issue, except in California and where otherwise prohibited by law.  

2. Terms and Conditions for Merchant-Offered Advertising

• A Merchant may purchase one or more advertising postings within a single transaction.  
• The fees and/or costs paid during each transaction shall be on a “per advertisement” basis. The associated fees and/or costs are indicated at the time of sale through our website. 
• The “Per Advertisement” cost is based on the size of the advertisement (half or full) and the number of households, based on the State(s)/County(s) selected by the Merchant at the time of purchase. In order to increase the effectiveness of the advertisement, the Merchant is required to provide a website address by which the advertising graphic may link to the Merchant’s website or other appropriate destination. 
• MyHomeCoupons.com reserves the right, at its sole discretion, to sell a limited number of advertisements per state, county or nationwide to ensure the appropriate ability of End Users to observe the advertisement during normal use of the Site. Rotation of Merchant advertisements during an End Users visit to the Site will be based on either a “refresh page” basis or an “automated rotation” basis as determined by the sole discretion of MyHomeCoupons.com. MyHomeCoupons.com does not guarantee Merchants a minimum number of “impressions”, “clicks” or any other commonly accepted online advertising measures. 
• As provided elsewhere in this document, MyHomeCoupons.com reserves the right to approve and/or edit prior to approval any and all advertising content in coordination and with the consent of the Merchant. In the event that MyHomeCoupons.com and the Merchant cannot reach agreement as to appropriate content, the Merchant agrees it only has a right to receive a refund of any costs paid for the specific advertisement in question. All rights to further compensation, remuneration or damages is hereby relinquished. 
• MyHomeCoupons.com agrees to display advertisements in the manner described above for 180 days from the date of purchase by a Merchant.  
• The Merchant hereby understands and acknowledges that MyHomeCoupons.com works with local HBAs to help generate revenues back to the local HBA, in order to enhance HBA programs and services to its members, through the purchase of advertising by Merchants through MyHomeCoupons.com. The Merchant hereby acknowledges that it is, at the time of the purchase, a member in good standing with the local HBA by which they have accessed this Site, using a unique login number and PIN. The Merchant hereby agrees not to seek any compensation or claim to other financial benefit accruing from the purchase of advertising through this Site, either from MyHomeCoupons.com or its local HBA. 
• As technology may allow, MyHomeCoupons.com may provide the Merchant with information regarding impressions, clicks, or other online advertising measures. The Merchant acknowledges that MyHomeCoupons.com is not expected or required to provide such data and information unless it decides to do so under its own discretion.

III. TERMS OF SALE – END USER PURCHASING OF COUPON(S)  
 
Upon placing an Order, an End User makes an offer to purchase selected coupons based on the terms and conditions stated below and elsewhere in this document.  
 
1. Terms and Conditions for End User Purchasing of Merchant-Specific Coupons

• Limit one (1) redemption per item purchased.  
• Limit one (1) Merchant-Specific Coupon per redemption.

• MyHomeCoupons.com will provide the End User with timely e-mail notification following the End User’s purchase of a coupon(s). In particular, this notification serves as a back-up means for the End User to maintain a copy of the coupon(s) purchased, in particular the barcode numbers associated with each distinct coupon purchased for the purposes of ensuring that a coupon presented by a person or persons at the Merchant’s place of business was generated by a valid purchase transaction using MyHomeCoupons.com.  
• The End User understands and acknowledges that MyHomeCoupons.com provides the Merchant with timely e-mail notification when an End User has purchased a coupon. This notification may include the End User’s: Name, Address, Phone Number, e-mail, the “last 4-digits” of their credit card and a unique barcode number generated by MyHomeCoupons.com for the purposes of ensuring that a coupon presented by a person or persons at the Merchant’s place of business was generated by a valid purchase transaction using MyHomeCoupons.com. The Merchant hereby agrees to honor any and all coupons presented by an End User that match the unique barcode number generated by MyHomeCoupons.com at the time of the End Users purchase through MyHomeCoupons.com.  
• The End User hereby understands and acknowledges that MyHomeCoupons.com works with local HBAs to help generate revenues back to the local HBA, in order to enhance HBA programs and services to its members, through the sale of Merchant coupons and/or advertisements by MyHomeCoupons.com. The Merchant hereby acknowledges that they are, at the time of the purchase, a member in good standing with the local HBA by which they have accessed this Site, using a unique login number and PIN. The Merchant hereby agrees not to seek any compensation or claim to other financial benefit accruing from the sale of coupons through this Site, either from MyHomeCoupons.com or its local HBA. 
• All coupons printed from the MyHomeCoupons.com website or any website associated with MyHomeCoupons.com (hereinafter “Coupons”) are promotional coupons that are offered to End Users below their face value and shall be honored only in combination with additional consideration and subject to the terms and conditions of MyHomeCoupons.com and the participating Merchant. Coupons do not provide End Users with an absolute right to redeem a coupon for its full value without such additional consideration.  
• By purchasing a coupon through MyHomeCoupons.com, the End User acquires the right to print a Merchant-specific Coupon. Whether the customer chooses to print the coupon is at the customer’s sole discretion. Whether the customer chooses to use the Merchant-specific Coupon after printing it to get a reduction in the price of a product or service is at the customer’s sole discretion. MyHomeCoupons.com and its participating merchants encourage customers to print the coupon and use them at the selected merchant.   
• The holder and issuer of a Merchant-specific Coupon is the merchant. As a holder and issuer of the coupon, the merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the merchant, as well as for any unclaimed property liability arising from unredeemed coupons. Merchant-specific Coupons are redeemable in their entirety only and may not be redeemed incrementally.
